Halle Berry and her daughterGabriel Aubrey's lawyer will almost certainly use the publication of the Kate Middleton topless photographs in his case to keep his and Halle Berry's daughter in America.

The actress is hoping to move to France with Nahla, four, with her actor fiance Olivier Martinez; however her case could be harmed if her model ex uses the new press issue in his argument, according to website TMZ.com. Halle's legal representative has been trying to convince the judge in her custody battle that their child is better off living in France with her mother because the paparazzi are more respectful of celebrities.

Gabriel was already using the paparazzi chasing Princess Diana to her death in 1997 as a reason she would not benefit from the relocation. Now Gabriel's lawyers could mention the images taken of the Duchess of Cambridge, which were achieved by an intrusive photographer who apparently used a telephoto lens to capture intimate shots of her on a secluded balcony.

Katherine Jackson isn't talking to three of her children.

The showbiz matriarch - who temporarily lost custody of late son Michael's kids Prince, 15, Paris, 14, and Blanket, 10, when she made an unexpected trip to a spa in Arizona - is unwilling to meet with Janet, Randy and Rebbie Jackson because she believes they misled her and didn't tell her that her grandchildren had been trying to contact her during her stint away from California. The siblings are reportedly banned from entering the home in Calabasas where Katherine lives with her grandchildren because they are at war with the executors of Michael's estate - which pays for the property - but their mother is said to be "heartbroken" over their recent behavior and doesn't want to see them.

Diana Ross is Willing to Take on Jackson Children

Diana RossDiana Ross is willing to take over guardianship of Michael Jackson's children.

The Motown legend was named as a back-up guardian for Prince Michael, Paris and "Blanket" in their late father's will, and although they are now under the shared custody of their grandmother Katherine and cousin Tito Joe "TJ" Jackson, she has made it clear she will step in and care for her godchildren if needed.

"For the first time, Ross said she was willing to step in 'if needed.' She had never spoken like that before. Whether she wanted to be listed as guardian or not, she's not going to abdicate any authority," a family member who was present during Diana's recent visit to see the kids told The New York Post.

After the recent drama of Katherine losing and then regaining guardianship, Diana wanted to make sure the children were fine and traveled to see them in person in Calabasas, California. "[After Michael's death in 2009, Diana would phone the kids to see] if they needed advice or anything else. But last week, she wanted to meet with the children in person to make sure she heard all the right things. Things you can't easily detect on the telephone, like body language," she added.

Jacksons to File Guardian Plea Today

Prince, Blanket, and Paris JacksonKatherine and Tito Joe "TJ" Jackson will file their plea for co-guardianship of Michael Jackson's children today.

Michael's mother and nephew are planning to share custody of Prince Michael, 15, Paris, 14 and 10-year-old Blanket after Katherine was stripped of her rights with temporary control given to TJ, and they plan to begin court proceedings tomorrow.

According to RadarOnline, Katherine's lawyer Perry Sanders said in a statement, "Before 10 this morning, Charles Shultz (TJ Jackson's lawyer) will give notice to interested persons that we intend to file a pleading tomorrow regarding co-guardianship. The pleading will speak for itself and be consistent with my prior statement issued on this subject. Tomorrow we will learn the court's pleasure on when and how [the judge] chooses to handle the request being made tomorrow. No further statements will be made regarding this pleading until subsequent to us learning how the Court wishes to proceed."

Katherine Jackson Explained Why She Left Her Grandchildren

Katherine JacksonKatherine Jackson says she didn't let her grandchildren know she was visiting their aunt in Arizona because she didn't feel like using the phone.

Michael Jackson's 82-year-old mother recently lost guardianship of his children Paris, Blanket and Prince Michael after she was thought to be missing for 10 days.

"There are rumors going around about me that I have been kidnapped. I am here today to let everybody to know that I am good and fine. My children would never do anything to me like that," she told ABC News.

When asked why she felt it was OK to leave three minor children in a house without a guardian, Katherine explained she simply felt like taking a "short vacation."

Katherine Jackson Loses Guardianship of Grandchildren

Katherine Jackson has lost guardianship of her grandchildren. The 82 year-old had legal custody of her dead son Michael's three children, Prince Michael, Paris and Blanket, but today her grandson TJ - son of Tito - requested and was granted temporary guardianship of the kids.

In California, Judge Beckloff said he wasn't suspending Katherine because of anything she did but because he is worried "intentional act from third parties" are stopping her from carrying out her duty of care to the kids.

Usher Wants to Settle Custody Battle in Wake of Jet Ski Tragedy

Usher wants to settle his messy custody battle with ex-wife Tameka Raymond.

The 33-year-old singer is keen to sort out a deal after his 11-year-old stepson Kyle Glover - the child of Tameka and her former partner Ryan Glover - was hit by a jet ski earlier this month and pronounced brain dead on Monday. Sources close the couple have told TMZ that Usher spoke to his lawyers earlier this week and asked them to construct a new proposal that will give Tameka "a majority" custody of their two sons, Usher Raymond V, four, and three-year-old Naviyd Ely Raymond. Usher is also said to be raising his child support offer "significantly" after Tameka reportedly refused an offer from him over the weekend that stipulated a 50/50 share of custody and a very slight increase in child support.

Katie Holmes to Get Primary Custody of Suri

Katie is also thought to have insisted that Suri is accompanied by the actress' own team of bodyguards when she visits Tom to ensure she isn't indoctrinated into sci-fi cult Scientology. "Katie insisted that Suri's nanny and bodyguards always accompany her when she visits Tom. Katie did this for several reasons. This will ensure a smooth and easy transition for Suri when she is with Tom. Suri is Katie's number one priority. Tom only has Scientologists that work for him and Katie insisted that her staff will always be with their daughter. Under terms of the settlement, Suri isn't permitted to be exposed to anything Scientology related and this includes going to any Scientology churches, parties, etc. Katie made sure that this was ironclad in the agreement," a source said.

Tom Cruise and Katie’s Divorce Talks Underway

Katie Holmes and Tom Cruise with their daughter SuriTom Cruise and Katie Holmes have begun discussing their divorce settlement.

Katie filed for divorce from Tom after five years of marriage late last month, and lawyers for both of them are now in talks to settle issues including child custody, visitation and child support for their six-year-old daughter Suri and property division.

According to TMZ.com, there are no immediate plans to go to court unless the negotiations fall apart. Should things go well, the settlement could be completed in New York, the city where Katie filed for divorce.

Katie is seeking sole legal and residential custody of Suri, and it is believed that she would more likely gain it in New York than in California, where Tom was thought to be filing his own papers.

Katie Holmes Files For ‘Emergent Application’

The 33-year-old actress' - who began divorce proceedings against estranged husband Tom Cruise last week - requested an "emergent application" in New York City court yesterday to determine immediate custody and child support issues over the couple's six-year-old daughter, Suri. The filing means Tom - who is being represented by Dennis Wasser, one of Los Angeles' top divorce lawyers - will have to hire his own New York-based attorney and the couple will have to appear before Judge Matthew Cooper on July 17 in an open court.

"Katie filed an 'emergent application' in New York City on July 3. It's a motion seeking temporary emergency relief, which can include child support and custody. It also means that Tom is going to have to hire a New York lawyer - he can't use his California lawyer anymore. The motion also means that both Tom and Katie have to be present in court on July 17. A judge is now assigned to their case, which means it's no longer going to be an out-of-court settlement. They are scheduled to appear before Judge Matthew Cooper on July 17 at 9:30am," a source said.
