Plea Deal Rejected! Lindsay Lohan Will Go to Trial

Lindsay Lohan - Court white dressTurns out, Lindsay Lohan didn’t need to wait out the judge’s March 25 deadline -- she’s already made her mind up about the plea deal.

And, it’s a no go. Linds made her wishes known on Wednesday by refusing to take jail time, though she would have served approximately 19 days, in favor of taking the case to trial. Lindsay Lohan is scheduled for a preliminary hearing on April 22. This will determine whether or not she should be charged with felony grand theft for allegedly stealing a necklace totaling $2,500.

The ruling could go badly for Lohan. If it is decided that she should stand trial, she could be immediately found guilty of violating her probation -- which will result in jail time anyway. It’ll be Lindsay’s fourth stint in the pokey.

Lindsay Lohan Receives Not-So-Secret Courtroom Deal

Lindsay Lohan necklace court appearanceThe California legal system is painfully learning the lesson that Lindsay Lohan has faced so many times: she can’t do one damned thing the media doesn’t discover. So it should come as no surprise that details from her highly-secretive legal bargain are leaking out of the courtroom.

Superior Court Judge Keith Schwartz has scheduled an April 22 hearing for Lohan’s grand theft case, but before this she may appear in court one final time to accept the offer he made to her on Thursday. Linds has now formally rejected a plea bargain offered to her, in which she’s been asked to plead guilty to felony theft. He’s giving her until March 25 to change her mind.

The plea would give her a possible 3-month jail stay, which is a lot shorter than the 3-year sentence she’s facing if convicted of felony theft. Linds could also face a penalty for probation violation, as she’s not supposed to get into any legal trouble right now (her being fresh from a different court case, and all).

It doesn’t help that the judge wanted none of the details of the plea bargain made public. The judge asked lawyers on both sides to keep the deets hush-hush, but TMZ (and everybody else) got ahold of them anyway.

Lindsay Lohan’s Lawyer Fires Back at Abuse Accusations

Lohan's on-again off-again attorney, Shawn Chapman Holley, is now firing back at last month's claims that her client was violating her probation -- specifically, consuming alcohol -- while at the Betty Ford clinic.
 
"I had numerous conversations with Betty Ford counselors and doctors over the course of Lindsay's treatment there and it was never suggested by anyone that she ever drank or used drugs. Her discharge letter from the facility is totally consistent with that," said Holley.
 
Right, and we should listen to the lawyer who maintained that Lindsay was in Cannes for work when she was incessantly photographed partying on a yacht, practically refusing to show up to her court case?
 
The new judge presiding over Lindsay's case, Judge Elden Fox, has previously said that Lohan will return to jail for up to six months should she violate the terms of her probation.
 
Until her progress review hearing on February 25, Lohan is subject to random drug and alcohol tests.

Lindsay Lohan Wants Probation Shortened

Lindsay LohanAs if it’s surprising: is trying to shorten the terms of her probation.

The troubled star’s legal team want the length of the court-ordered terms - which are presently scheduled to run until August 2011 - lessened, as they fear she will “get in trouble” before the period ends. Lindsay is presently in the Betty Ford rehab center in Los Angeles, following two spells in prison this summer; serving 13 days of a 90-day jail term in July before briefly being returned in September after failing drug tests, although she was released hours later on $300,000 bail.

“The longer Lindsay stays on probation, the increased chances that she will get in trouble because of problems staying compliant with the terms of her probation. The only person that can modify terms of Lindsay’s probation, or terminate it early, is Judge Elden Fox.”

Lindsay could again face a return to prison, as she is due in court on October 22 for a probation hearing, after her failed drug tests, which could see her incarcerated again for violating the terms of her probation for a 2007 driving under the influence (DUI) conviction. Friends of the star have said she isn’t worried by this prospect, however, and is prepared to return to jail. “The fact is jail doesn’t scare Lindsay. Before she did her time earlier this summer, she was petrified. Having spent time behind bars, it doesn’t have that effect on her. Jail isn’t a deterrent for her, period,” one source said.


Predicting Lindsay Lohan’s Future: To Jail, or Not to Jail?

However, new courthouse whispers suggest that Lohan won’t spend even a single night in the pokey. Lindsay’s crimes are misdemeanors, which means bail will be set - and it will definitely be paid ASAP.

But that doesn’t mean the actress is totally out of the woods. will go before the judge again in October for her probation violation hearing, where it is very likely she will be sentenced to 30 days for the first positive drug test (cocaine). Even so, the LA jails are still highly overcrowded, so it’s doubtful Linds will serve even one day of her 30-day sentence.

Probation Extended For Nicole Richie

Nicole Richie and her babyLindsay Lohan could learn something from , who recently extended her probation.

The socialite - who was put on probation in 2006 following a driving under the influence (DUI) offence, after being arrested for driving the wrong way down a Los Angeles motorway and failing a sobriety test - was told it wouldn’t be terminated next month as expected, because she hasn’t attended enough alcohol education classes.

According to her lawyer Shawn Chapman Holley - who appeared in a Los Angeles court yesterday - the 28-year-old starlet failed to complete the course because she has been too busy looking after her children Harlow, two, and nine-month-old Sparrow, her kids with her rocker fiance Joel Madden.

Her probation period has now been extended to March 2011, but the judge has promised to terminate it early if she completed the alcohol program before then. Despite the extension, Nicole has been praised for her work on the course so far. Her report states, “Her attitude is excellent.”

Warrant for Lindsay Lohan Recalled

Following the ceremony, Linds partied a little too hard - or at least, that’s the story her SCRAM bracelet tells. After Lohan’s alcohol-monitoring device went off Sunday night, alerting authorities that she was in violation of her parole, a bench warrant was issued for her arrest.

The warrant was later recalled after a bail bondsman posted $20,000 - 10% of her $200,000 bail - to keep free from custody.

The actress turned to her - predictably - to deny the allegations that she violated her parole. Linds wrote: “My scram wasn’t set off-Its physically impossible considering I’ve nothing for it to go off-All of these false resports are absolutely wrong.”

Lindsay Lohan Submits to Random Drug Tests, SCRAM

Lindsay Lohan in courtAfter a weekend of hardcore partying in Cannes, is back in the states and has been ordered to submit to random drug testing.

The

actress appeared in a Beverly Hills court today for a probation review hearing, where she was told by Judge Marsha Revel she can remain out on bail, but only if she abstains from drinking alcohol, wears a SCRAM bracelet - which monitors alcohol consumption - and attends at least one alcohol education class a week.

The judge also indicated the 23-year-old star must stay in the Los Angeles area, despite her being lined up to work on a movie in Texas. A formal hearing to determine if Lindsay has violated her probation - which she was placed on following her second driving under the influence (DUI) conviction in 2007 - has been scheduled for July 6.

If she is found in breach of the terms, Lindsay - who is expected to face at least five drug tests before then - could be jailed for 180 days. Lindsay was originally scheduled to appear in court last Thursday, but was stranded in Cannes, France, after claiming her passport had been stolen.


Is Lindsay Lohan Going to Jail?

Lindsay LohanTMZ seems to think so. The gossip site has learned that could be in serious trouble with the law for not following the terms of her court-mandated alcohol education classes. It’s a violation of her probation, and there’s good reason to think she’ll end up doing hard time as a result.

Judge Marsha Revel ruled that LiLo must attend alcohol classes at least once every seven days, unless Lohan received treatment through inpatient rehab. The judge ruled that if Lindsay violated this agreement, Lohan would be going to jail. Well…she’s violated it.

Lindsay Lohan will face the music on May 20, a progress hearing where it will be revealed that Lohan frequently waited up to 21 days to attend her court-mandated courses. If the judge holds firms to her former ruling, Miss Lohan will find herself behind bars before the day is out.
