Kate Middleton Photos Could Affect Halle Berry

Gabriel Aubrey's lawyer will almost certainly use the publication of the Kate Middleton topless photographs in his case to keep his and Halle Berry's daughter in America.

The actress is hoping to move to France with Nahla, four, with her actor fiance Olivier Martinez; however her case could be harmed if her model ex uses the new press issue in his argument, according to website TMZ.com. Halle's legal representative has been trying to convince the judge in her custody battle that their child is better off living in France with her mother because the paparazzi are more respectful of celebrities.

Gabriel was already using the paparazzi chasing Princess Diana to her death in 1997 as a reason she would not benefit from the relocation. Now Gabriel's lawyers could mention the images taken of the Duchess of Cambridge, which were achieved by an intrusive photographer who apparently used a telephoto lens to capture intimate shots of her on a secluded balcony.

-Things appear to be heating up between Gabriel Aubry, Halle Berry's ex, and Kim Kardashian. The two have been spotted out together several times over the past week.

-Is (the now) 18-year-old Miley Cyrus dating Victorious actor Avan Jogia? Or does she simply welcome nuzzles from Nickelodeon stars in lieu of birthday gifts?

-The holiday seemed especially warm for Taylor Swift and Jake Gyllenhaal. Taylor was sighted with Jake in New York on Thursday. The actor was then seen in Nashville with Swift on Saturday.

UPDATE: It’s now being reported that Berry was the one who did the dumping—and she did it months ago.

Let’s face it kids: You can try color-coordinating your family all you like, but that won’t necessarily keep you together.

Although they appeared to be the image of perfection, Halle Berry and Gabriel Aubry proved once again that pretty people also have a hard time being happy. After four years together, the actress and the model have called it quits.

According to reports, the two have actually been apart for some time and have already begun working on a custody agreement regarding their 2-year-old daughter Nahla. (RadarOnline.com says they’ve “spent months hammering out a deal with a lawyer” while TMZ is claiming Berry “went to a divorce lawyer three weeks ago.”) All sources are claiming, though, that the split appears to be going amicably.

Some families have the looks. Others have style. Then there are those who make us want to cry because they’re blessed with both.

Now, I don’t know about you—but I can’t recall the last time my husband and I looked runway ready, let alone color-coordinated, the last time we walked off an airplane. But Halle Berry, Gabriel Aubry and their daughter Nahla somehow managed to pull it off during their flight to LAX yesterday.

Is there something besides free alcohol that I’m missing up in first class?
