Chris BrownChris Brown failed a drug test, but a judge has ruled against revoking his probation.

The singer - who is currently on probation after attacking his then girlfriend Rihanna in 2009 - tested positive for marijuana in June in Virginia, where the drug is illegal, but since he claims to have smoked it in California, where he has a medicinal marijuana card, Judge Patricia Schnegg has let him off with a warning.

However, in court in Los Angeles on Monday, Judge Schnegg ordered a review of his progress on November 1 amid concerns about how many community service hours he has completed and allegations he has violated the terms of his travel restrictions. She also urged him to consider how the public and his young fans perceive his actions, telling him "You are not an average person sitting in a living room. You are not only in the public eye, but you are on probation."

Chris BrownChris Brown has been ordered to appear in court next month.

The singer was called in as part as a routine progress hearing on Tuesday as part of his felony battery conviction for assaulting then-girlfriend, Rihanna. While he didn't attend in person to report this time, Judge Patricia Schnegg, has expressed concerns about a discrepancy in hours that the Grammy Award-winning star had completed in his required community labor.

The judge asked the probation department to establish where Chris resides because he owns a home in Los Angeles, California and had been doing his community service in his native state of Virginia. She also wants an audit done on Chris' hours to ensure the accuracy leading to her order for him to appear at his next progress report on August 21, according to website RadarOnline.

Last month a fight broke out between Drake and Chris' entourages in a New York City club that resulted in Chris receiving stitches for a gash to his chin. There were multiple injuries from shards of glass from broken bottles, including Eva Longoria's ex-husband, Tony Parker.
