Charlie Sheen may have only been in jail for less than a day, but it’s doubtful he’ll be celebrating this New Year’s Eve.

The actor, who was arrested on Christmas Day for some type of domestic violence-related incident, is reportedly back in Los Angeles after a short stay in a Colorado jail. Meanwhile, wife Brooke Mueller was recently spotted in Aspen—the same city where Sheen was taken into custody on Friday.

Although the Two and a Half Men star was initially booked for second-degree assault, menacing and criminal mischief, formal charges have not yet been filed by prosecutors. Unfortunately, Mueller, who was reportedly drunk when she made the 911 call, has not been cooperating with authorities and has since tried to recant her statement. One claim she made is that Sheen threatened her with a knife.

The status of Brooke and Charlie’s 2.5 year-marriage prior to the incident varies from source to source. Some claim the two had been fighting for some time and were in fact in the middle of a quiet separation. Others cite sources who say the two were never separated at all.

Regardless, the two will have a lot to work on should they plan to stay together. “Both [Charlie] and Brooke will undergo counseling and Charlie will get anger management counseling,” an insider told People.

Richard Cummins, Sheen’s Colorado-based lawyer, also claims the two want to repair their marriage. “They have two children together and they love one another and they’re going to work through what is a difficult time and they’re going to do that together and as privately as possible,” Cummins said.
