I really hate people some times. 3% isn’t a significant amount of defective units to warrant any type of massive recall or warrant a lawsuit. I remember that when the PS2 first came out they had some issues and the first generation ones started breaking about 2 years later.

you just found that out now? this news has been out for a while now! You’ve been playing with you xbox360, havent you?
anywho, this guys case will be thrown out as his unit is under full warranty and its probably also returnable to the store of purchase.
