Hey all,
Episode 91 of GamerAndy Live is assembled and rolling out to an iTunes near you!
This week our new Regulars, Elaine and Jones join me for another 2+ hour discussion of a variety of topics ranging from TGS to Bioshock - Two Weeks later.  Honestly I felt like the first half of the show was a little lacking from me because I hadn’t eaten and was pretty subdued, but during the break I had 3oz of dark chocolate and was good n’ fiesty for the remainder of the show.  The music during this weeks break is “If I had a Million Dollars” by Barenaked Ladies

Yay for Cube refrence! I whole-heartely agree with what Jones says about Shoot ‘em Up. I can’t really remember much past what I just listened to because I’ve gotten no sleep. Either way I’m really liking the more recent shows. Good stuff.

According to tv guide at http://www.tvguide.com/detail/tv-show.aspx?tvobjectid=191395&more=ucshowairings, the new series starts Saturday the 29th of September and it’s being shown at 2AM in the morning.  I think even the Sci-fi network is sick of this show and just wants to fulfil its contract.

I enjoyed the mini series; the first and parts of the second series.  Then it turned into a soap.  I was starting to expect them to over act; the way they do on daytime soaps.

I think they need to cut to the chase.

1: Who the hell are these original 5 Cylons?

2: Is the good doctor a Cylon?

3: this is a way out there thiery but; imagine if it turns out that the humans are all Cylons and they never left their planet.  It would be a terrible ending but based on the suck fest that was season 3, I would put it past them.

4: Why is almost everyone obsesed with sex?  I know space is boring but come on.

Two points that jumped out at me that I’d, if you kindly, like to correct.

1.  A minor point but, Heroes season 2 does not start in October. In fact it will have it’s season premier about 3 hours before the release of Halo 3 (East coast time). That’s 9 pm September 24.

2, As far as movie ratings go, a film can have an NC-17 rating and still be shown in your local cineplex, contrary to popular belief. I too was suprised to learn this the first time the theater I have a part time job at showed A Dirty Shame

Though such a rating may not be as commercialy lucrative for the studios, hence a reluctance to release, there is absolutly nothing to prevent it from being distributed as long as there are theater chains willing to buy and exhibit the movie on their screens and it doesn’t violate community standards.

R- rated films will allow a person under the age of 17 to attend so long as they are accompanied by their parent or guardian.
NC-17 - rated films No one 17 years of age or under is admitted .

This is the same as AO rated games.  There is nothing legally preventing an AO game from being released.  It will just not make any money due to the failure of major retialers to carry the title.  The bigger problem for an AO game is the refusal of the platform makers to license the game.  That IS a death sentence.

What would prevent someone from making an unlicensed game and publishing it independently, if that’s even possible? 

What springs to mind is back in the Super Nintendo era, I remember that someone was creating games for the SNES based on stories from the Bible. I’m not sure, but I don’t recall them being licensed and they certainly weren’t on the shelves of your local EB Games / Gamestop.

Is it even possible to do an end-run around Sony / Microsoft and create an underground market? Getting Dev-kits would be a problem, I’m sure, and there would be no way in hell that you’d ever get it onto Live, but if you somehow had the means of manufacturing a disk, what then would prevent you?

I believe what prevents you is the DRM for the consoles and the army of lawyers all three companies employ.

The consoles are so locked down to prevent piracy as much as possible, without the licenses, you can not legally manufacture the discs with the proper copy protection embedded in the discs to run on the console.

If you circumvent them, then you are violating their DRM rights.  This leaves you up to losing a helluva lot more money in court than you could possibly make on your game.

Unlicensed peripherals are possible for consoles, because you are using existing technology and not reverse engineering methods to allow them to work on a console.  This is why there are NO unlicensed 3rd party wireless controllers for the 360, but you can do a USB wired controller with no problem.

Ah, well, my original point was that although an AO rating may be the kiss of death in the realm of video games, an NC- 17 is not so in the world of movies as I thought was implied from the commentary in the podcast.

I think you are right on both points.  I think it was implied that it was a kiss of death for NC-17.  While not a kiss of death per se, it severely impacts the possible revenues from the box office.  Many screens will refuse to show it while others will.  The moview would no doubt make more money rated at R.

Of course, they bypass all the NC-17 ratings on DVD releases with the “Unrated” versions which will sell just fine.

Funny that stores that will not sell an AO videogame will sell Unrated material when it comes to movies.
