Gabriel Aubry Won’t Be Charged for Martinez Fight

Gabriel AubryThe dust is finally settling around the Thanksgiving fight involving Halle Berry's former and ex lovers, Olivier Martinez and Gabriel Aubry, respectively. Aubry, who is the father of Halle's four year-old daughter Nahla, has been told by the Los Angeles Police Department that he will not be charged for the assault, despite their investigative conclusion that he instigated the brawl.

Berry and Martinez have decided not to pursue criminal charges against Aubry in order to protect Nahla. Aubry is expected to attend an informal meeting with the LAPD to discuss the incident.

A source close to the situation believes that Aubry will most likely agree to taking anger management classes. "It seems he's still having a hard time getting over his break up with Halle," the insider said.

Martinez and Berry were last spotted attending a boxing match between Manny Pacquiao and Juan Manuel Marquez in Las Vegas.

The model is unlikely to face charges over last week's brawl with the French actor - which occurred when he took his four-year-old daughter Nahla back to the home she shares with mother Halle Berry and her current partner - but documents appear to show he was at fault for the physical row.

According to documents obtained by website TMZ, after interviewing Gabirel, Halle and Olivier, the investigating officer concluded, "Suspect [Gabriel] arrived at victim's [Olivier] residence for child custody exchange. Suspect and victim engaged in verbal altercation. Suspect became upset and attempted to punch victim's head but missed and struck victim's right shoulder instead. Victim returned with three punches to the suspect's head, causing him to fall to the ground. Victim's fiancee notified police. Victim defended himself and punched the suspect."

The Canadian model - the father of Halle Berry's four-year-old child Nahla - was involved in a vicious altercation with the French actor, who is engaged to the brunette actress, on Thanksgiving when he was dropping his daughter back to her mother's house - but he claims to have done "absolutely nothing" to "provoke" Olivier.

"Gabe wants criminal charges brought against Olivier for beating the living daylights out of him on Thanksgiving. Gabe can't believe that he was the one arrested when he says he did absolutely nothing to provoke the attack. If you look at the pictures of Gabe's hands after the fight, there isn't one scratch, nor did he suffer any wounds to his hands, as Olivier did. Gabe says he was rendered defenseless because he was knocked to the ground by Olivier's punches. Remember, Olivier's father was a former professional boxer and he has trained for years also," a source close to the situation said.

Gabriel Aubry’s Visitation Rights Reinstated

Gabriel AubryThe temporary emergency protection order against Gabriel Aubry has been lifted.

The Canadian model was banned from seeing his four-year-old daughter Nahla following a brawl on Thanksgiving with Nahla's mother Halle Berry's boyfriend Olivier Martinez, but a judge ruled on Tuesday to remove the court order.

According to RadarOnline, "[Gabriel] will be allowed to resume visitation with Nahla, with unspecified precautions in place to protect her safety." The ruling comes after it was revealed Gabriel is seeking a restraining order against Olivier, preventing him from having any contact with Nahla.

"Gabe will ask the judge to prohibit Martinez from having any contact with Nahla. Gabe believes that the judge will be disturbed by the fact that Olivier suddenly inserted himself into the custody hand off on Thursday. Halle's nanny/housekeeper is supposed to be the go-between for the parents when Gabe picks up and drops off Nahla," a source said.

The 36 year-old model is seen with an extremely swollen black eye and several lacerations on his face. He was also treated for broken ribs and a swollen face following the fight on Thanksgiving. His hands were also photographed by the police to prove that he was not involved in the fight, as his lawyers are set to accuse Martinez of prompting the brawl.

Aubry is now claiming that Martinez threatened to kill him, and sought and acquired a restraining order against the restaurateur. He is also seeking to have the emergency protective order Halle filed against him for her and their daughter lifted.

The model - who is the father of Halle Berry's four-year-old daughter Nahla - reportedly attacked the actress' French fiance Olivier on Thursday morning when he was dropping the tot back at Halle's house, but came off worse in the fight.

Gabriel was taken to hospital for his injuries and charged with battery, while Olivier did not need extensive medical attention for his own wounds but wants to press charges. A source told gossip website TMZ, "Gabriel went nuts," in front of Halle and other witnesses.

The fight comes after Halle, 46, recently had her bid to move Nahla to France with her and Olivier, denied by a judge. Gabriel, a Canadian model who lives and works in Los Angeles, had petitioned the court to stop Halle's plans as it would give him limited access to his daughter, while the Cloud Atlas actress argued the privacy laws are stronger in France and would keep Nahla safe from the paparazzi.

Halle - who split with Gabriel in 2010 - and Olivier, had put their wedding plans on hold while the actress focused on her custody battle but she revealed they hoped to have a child together soon. "We pray to God, so sweet. She says, 'God, please bring me a bunk bed and a baby sister.' And I say, 'I can do one of those things, I know for sure. The other one, we've got to keep praying on.' What do you say to her when she wants that and can't understand why God's taken so long?" she said.

Gabriel, 36, had gone to court last month to request the sum but the case was adjourned because paperwork wasn't filled out properly.

The former couple - who split in April 2010 - are yet to resolve another dispute over Nahla, as the model is unhappy with Halle's plan to move to France with the youngster and her fiance Olivier Martinez. The 45-year-old Dark Tide star has previously spoken about relocating to France, in favour of the country's laws which will protect her offspring from prying eyes. "Laws that protect children, protect right to privacy. All I want is for my family and myself to have a normal life. When I'm not at work, that's very important to me," she said.

A court has yet to rule on Halle's desire to move.

The bottom line is that the proposed move to France would essentially cut Gabriel out of Nahla's life and the child psychologist determined that wasn't in the little girl's best interest. However, this is just a report, it will be up to a judge to ultimately decide if Halle will be allowed to move to France with Nahla," a source said.

Gabriel Aubry Wants More Money from Halle

Gabriel Aubry and daughter NahlaGabriel Aubry wants to "substantially increase" the monthly payments he receives from Halle Berry.

The model is currently embroiled in a bitter battle with the actress over the custody of their four-year-old daughter Nahla and was in court today with his ex-girlfriend to ask for a raise in the amount of money she pays to him, according to RadarOnline. However, he did not get the chance to have his case heard as the judge granted a continuance.

Halle wants to move to France with Nahla and her fiance Olivier Martinez because of concerns about the paparazzi and the child's safety, but her ex is trying to stop her from re-locating because he believes he won't get to see his daughter. It was previously revealed Gabriel - who split from Halle in 2010 after five years together - was worried Oliver is planning to adopt Nahla.

"Gabriel fears that Halle's ultimate plan is to get him out of his daughter's life, permanently. He believes the plan is for Halle to move to France with Nahla and then have Olivier adopt her as his own. She wants a 'fresh start' apparently. Gabe will fight tooth and nail to retain custody of Nahla. He loves that little girl and is determined to always be a part of her life and always be her father. Just because Halle is through with him doesn't mean she can shut him out of her daughter's life too. Gabe may not have Halle's money or power but he will not just lie down and take it," a source said.
